DESCRIPTION: Utah law requires that each county recorder shall keep a grantor index, which indexes all deeds and final judgments affecting the title or possession of real property. This index must include: grantor's or seller's name in alphabetical order, grantee's name, date of the instrument, date of filing, kind of instrument, number of instrument, consideration, book and page number where recorded, and a brief description of the premises (Utah Code, Unannotated, 1988, 17- 21- 6). This law, enacted by the Territorial Legislature in 1888, prompted the Washington County recorder to begin keeping this index (Laws of the Territory of Utah, 1888, chapter XLIX, section 7). The grantor index provides access to a wide variety of documents relating to land ownership. These include different kinds of deeds, mortgages, notices, affidavits, decrees, mining claims and patents. The Washington County recorder also made reference to some documents not related to land ownership. These include military discharges, bonds and oaths of office.
ARRANGEMENT: The county recorder kept a running index, grouping entries according to the first letter of the grantor's surname. Under each letter she filed entries chronologically.
RESEARCH NOTE: The recorder designated sections of Books 1, 2 and 3 to make entries for each letter of the alphabet. When a particular section became full, she continued entries at the end of a section designated for a different letter. In Books 1 and 3 this is occasional, but in Book 2, the recorder continued in a different sections so frequently that the index is extremely confusing. Each letter is also continued in the next book on a different date. In Book 1, for example, inclusive dates for the letter B are 1888-1917, and for K they are 1888-1937. Book 2 includes 1917-1934 for B and no entries for K. Entries in Book 3 commence between 1931 and 1937 and all end in January 1940. Beginning with Book 4, each book has specific inclusive dates, with the exception that entries are carried from Book 10 to 11 on different dates for different letters. In Book 5 the recorder frequently used pages preprinted for the grantee index. The words "grantee" and "grantor" should be reversed to properly read the index.
