DESCRIPTION: Probate case files are a collection of all documents and actions pertaining to the probate of wills following death which have been filed with the court clerk. Included are some guardianships, adoptions (until 1924), and commitments (until 1920). Records and documents pertaining to a particular action are filed together by the court clerk, who is required by the Rules of Civil Procedure to file pleadings and other legal papers. Collectively they constitute the case file. Case numbers are assigned by the court when papers are initially filed with the clerk.

Files for probate cases include such documents as wills, decrees, continuations of hearings, discharges, petitions, notices, bonds, letters testamentary, testimonies, findings of fact and conclusions of law, commitments, affidavits, proof of publication, appraisements, reports, orders, depositions, property inventories, etc.

ARRANGEMENT: The Weber County probate case files are arranged numerically by consecutive case number.

RESEARCH NOTE: Evidently the current probate case numbering system began approximately 1897. When cases originally filed with the Weber County Probate Court (between 1851 and 1896) were transferred to the district court, the territorial cases as well as those filed during the first year of statehood were assigned numbers presumably based on an existing alphabetic arrangement (cases 1-671). Since the adoption of the current numbering system, cases filed in the district court have been assigned numbers according to the date of filing.

For most probate cases filed since statehood it is advisable to obtain the file number from the Weber County District Court Clerk in order to use the archives's microfilm copies of the case files effectively. Reference service on probate cases filed from 1970 to the present is provided exclusively by the Court Clerk.

Later index volumes and estate registers remain in the custody of the court clerk. A daily record of documents filed and actions taken with regard to every matter brought before each session of the Weber County Probate Court is found in MINUTES, 1883-1896 (series 5142).

Copies of wills, court orders, administrator's and executor's bonds, letters testamentary, and related documents are transcribed in PROBATE RECORD BOOKS, 1879-1959 (series 6405).

FINDING AIDS: A one-page index listing 17 individuals in alphabetic order precedes the "Ancient" files on reel 1. The 17 "Ancient" files do not duplicate cases 1-17 on the following reels. A general index to Weber County Probate Court Files (series 21023) includes 810 probate cases. This volume (identified as Index Book 1) is the only index to Weber County probate matters which has been transferred to the archives. A research guide entitled "Judicial/Court Records at the Utah State Archives" is available for patron use.

ACCESS RESTRICTIONS: These records are public with the exception of adoption records, which are sealed for 100 years according to Utah Code Annotated 87-19-4 (1953), and commitment proceedings, which are classified by the Administrative Office of the Court as private (Code of Judicial Administration, Rule 4-202, section 3 [G] [iii]). Since restricted information is recorded together with public information, the series must be searched for patrons by staff members. Contact a reference archivist for more information.

CUSTODY HISTORY: The Weber County Clerk was constitutionally designated as ex-officio clerk of Second District Court in and for Weber County until 1989 when the state assumed full financial and administrative responsibility for the district court. At that time a new court clerk was appointed. The probate case files were microfilmed by the Weber County District Court Clerk at regular intervals beginning in 1973. Reference copies were provided to the Utah State Archives.

PROCESSING NOTE: Case files were designated as a permanent record by Records Disposition Request 1979-52, which also authorized microfilming and destruction of the original records. The records retention policy of the Utah Judicial Council reprinted in the 1983 state retention schedule first specified a nine-year retention before microfilming. The clerk's office microfilmed cases at regular intervals beginning in 1973. The probate case files were archivally processed by W. Glen Fairclough, Jr., in May 2001.

PREFERRED CITATION: Cite the Utah State Archives and Records Service, the creating agency name, the series title, and the series number.

GAPS: Some missing case files are noted at the beginning of the reel, i.e., reel 178.
