DESCRIPTION: Federal mining law enacted in 1872 provided that all valuable mineral deposits in the public domain were free and open to exploration and that the locators of the same were to have exclusive right of possession as long as they complied with the laws of the United States and of the local mining district. (Statutes at Large, Treaties, and Proclamations, of the United States of America, vol. XVII, chap. 152, also Revised Statutes of the United States, chap. 6, title 32). Federal law outlined that the first step toward ownership of mineral deposits was the discovery of a potentially productive site and recording the claim or notice of location. Primarily, the location notices in these books are for lode claims, which are are identified sections of veins or lodes of quartz or other rock bearing gold, silver, cinnabar, lead, tin, copper, iron or other valuable deposits. A claim may equal but not exceed 1500 feet in length along the lode. Each notice of location recorded in these books contains the following information: name of claim, names of locators, date claim was located, date notice was filed, and a legal description of the claim including dimensions. In addition to location notices, these books contain the by-laws of Iron County mining districts. They contain documents relating to location notices, such as amended notices of location, mill site location notices, location certificates, and some notices of location for placer claims (see Book E).
ARRANGEMENT: Mining notices were recorded chronologically as filed by the county recorder.
RESEARCH NOTE: Location Notices B 1, C 1, and D are faded and difficult to read. When Book C 1 became full, the recorder went back through the book, recording notices for January 1900 on blank pages which had been left throughout the book.
RELATED RECORDS: MINING LOCATION NOTICES INDEXES, series 23954, provide reference to the documents recorded in these books after 1920. Reference is both by name of claim and names of locators. Location notices recorded in the 1950s are also referenced in MINING ABSTRACTS, series 23955. From 1906 to 1918, the Iron County recorder recorded additional location notices in Mining Records Book 2, which was also used to record MINING DEEDS, series 23951. The bulk of location notices for placer claims have been recorded in MINING LOCATION NOTICES (PLACER CLAIMS), series 23952. Some location notices recorded during the territorial period were recorded by the Silver Belt Mining District recorder, the Pinto Iron Mining District recorder or the Stateline Mining District recorder in LOCATION NOTICES, series 23968 or series 23961, or in STATELINE MINING DISTRICT RECORDS TRANSCRIPT, series 23969. Documents validating proof of labor being being performed on mining claims have been recorded in MISCELLANEOUS RECORDS, series 23981.
