CIVIL CASE REGISTERS OF ACTIONS, 1902-1968.

DESCRIPTION: The register of actions was used by the court as a record of all documents filed in relation to a specific case. the first entry is typically a notice of the filing of a complaint followed usually by an answer of the defendant. This is followed by one or more summonses and returns of complaints or other documents as appropriate to the individual case. A notice of judgment made or that a garnishment of wages or an attachment of personal property was filed typically ended the case. Routine actions are stamped into the volumes; others are recorded by hand. Not all cases reached the trial stage; but when one did, a full record of actions taken in the case is also entered. Exact charges in the case are not shown, but other information in the entry includes names of parties involved--most often the name of the business bringing action against an individual--and the names of attorneys for both plaintiff and defendant.

The city court held jurisdiction in actions for the recovery of money or breach of contract; actions to recover damages to persons or property or the property itself; actions to recover fines imposed by statute; and actions to enforce or to foreclose liens on personal property. The types of cases recorded in the register corresponds to these categories. Until 1921 the court held concurrent jurisdiction with the district court in all matters relating to personal property and damages related to forcible entry or detainer. Initially the limit on damages that could be asked in cases filed in city court was $500. This was raised in 1921 to $1,000. Claims for greater amounts would be filed in the district court. After 1933, small claims departments were created in city courts and cases for damages less than $50 were filed there.

ARRANGEMENT: Cases were recorded numerically by case number, with numbers assigned chronologically by date of initial action. Within each case, entries were chronological by the date a document was filed. Once case numbers reached approximately 100,000, numbering restarted beginning with number 1. This happened twice: first in June 1939; then again in January 1964.

RESEARCH NOTE: Beginning with reel number 140, the last case included on the prior reel is refilmed to start the succeeding reel on all but three of the reels. Original records were bound in numbered volumes, the spine of which is reproduced on the microfilm copy. Specific pages that were retaken appear at the beginning of the reel.

RELATED RECORDS: The records of city courts, as with most lower level court records, usually have a limited retention. However some have been preserved, at least in part. CRIMINAL AND CIVIL SAMPLED CASE FILES, series 1620, contain some of the cases registered in this series. CIVIL CASE REGISTERS OF ACTION DEFENDANTS INDEX, series 13687and CIVIL CASE REGISTERS OF ACTION PLAINTIFFS INDEX, series 13688, provide name access to this series. CIVIL CASE DOCKET BOOKS, series 23870, were retained and contain similar entries regarding parties, proceedings, and fees.

FINDING AIDS: Separate alphabetical name indexes were created by the court and are available as separate series, see RELATED RECORDS.

PROCESSING NOTE: The series was transferred to the Utah State Archives in 1968. A permanent retention was assigned to the series in 1983. The bound volume were destroyed after microfilming in 1993. Archival processing was completed in 1994 by Steven R. Wood. EAD entry was done in 2001 by A. C. Cone; the related records section was modified as well at that time to document only those series retained permanently.

PREFERRED CITATION: Cite the Utah State Archives and Records Service, the creating agency name, the series title, and the series number.

GAPS: Any cases that might have been filed between 13 June 1938 and 1 June 1939 are missing. Case numbers 10201-10800, 6 June 1943 to 8 September 1943, are also missing.
