PROBATE RECORD BOOKS, 1883-1898

DESCRIPTION: These three volumes were used to record fees charged for services rendered in probate cases. Printed columns are available to record date (month, day, and year), items, costs assessed for judge, clerk, sundries, and estate, and remarks for each case. Notations are handwritten. The space reserved for case numbers is unused. Volume A covers 30 October 1883 through 28 November 1891, volume B spans 18 December 1891 through 29 April 1896, and volume C encompasses the period from 13 May 1896 to 19 December 1898.

The territorial Cache County Probate Court, predecessor of the state district court, originally produced the probate account books.

ARRANGEMENT: The first 26 case entries in the probate account books are in random order. Thereafter, entries are chronological according to original filing date. Notations for individual cases appear in chronological order.

RESEARCH NOTE: Because no case numbers are recorded, researchers must obtain that information through the Register of Actions or probate index. Because of the unusual jurisdiction of the probate court, there is a remote possibility that the account books include isolated civil and criminal matters as well as probate cases.

RELATED RECORDS: Account books were superceded by the REGISTERS OF ACTIONS (series 22724), which record similar information for these probate cases, as well as corresponding case numbers. Information written in the registers can be used to locate pertinent entries in the PROBATE MINUTE BOOKS (Series 22905). Corresponding case numbers are available through the PROBATE INDEX (series 22659). A collection of all documents and actions pertaining to the probate of wills following death which have been filed with the court clerk make up the PROBATE CASE FILES (series 1532). Copies of wills, bonds, letters testamentary, and related documents are transcribed in PROBATE RECORD BOOKS (series 767).

FINDING AIDS: An alphabetic name index is included at the front of volumes A and B. A research guide on court records is available for patron use.

CUSTODY HISTORY: The Cache County Clerk was constitutionally designated as ex-officio clerk of First District Court in and for Cache County.

PROCESSING NOTE: The 1986 General Retention Schedule authorizes destruction of district court fee books following a three-year retention (page 40). However, since few records of the territorial Cache County Probate Court survive, microfilm copies of the account books are being retained permanently to document the activities of the court.

Volumes A-C were filmed by the Genealogical Society of Utah in May 1966. Copies were purchased by the Utah State Archives and Records Service. These reels were archivally processed by W. Glen Fairclough, Jr., in May 2000.
